The Pigford Cases

In 1997, Black farmers brought a class action lawsuit against the United States Department of Agriculture (USDA), alleging (1) racial discrimination when the agency denied and delayed applications for credit and other Farm Service Agency (FSA) programs, and (2) when they filed complaints of discrimination, the USDA did not resolve or even properly investigate those complaints. The case, Pigford v. Glickman, was settled in 1999, but the high number of potentially eligible claimants who were not able to file claims by the deadline necessitated a second case, In re Black Farmers Discrimination Litigation. Also known as Pigford II, the second case’s settlement agreement was approved in 2011 and payment was sent to approved claimants in 2013.
